1. Provider & Acceptance

Migla is a service operated by SIA "MIGLAI", a limited liability company registered in the Republic of Latvia under number 40203733943 ("Migla", "we", "us"). By accessing or using Migla you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms apply to all visitors, registered users, and anyone who accesses or uses the service. If you do not agree, you must not use Migla.

2. Eligibility — 18+ Only

Migla is an adult-only service. You must be at least 18 years old to create an account or use the service. By registering, you confirm that you are 18 or older. We will terminate any account we discover to be operated by a person under 18 and delete associated data.

3. Description of Service

Migla is an AI-powered image and video generation platform that allows users to create, transform and enhance visual content using artificial intelligence models. The service includes image-to-image transformation, image-to-video generation, character generation, community and related tools. We reserve the right to modify, suspend or discontinue any aspect of the service at any time.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Acceptable Use

You agree not to use Migla to generate, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory or otherwise objectionable. You must not: (a) create non-consensual sexual or intimate deepfakes; (b) impersonate real people in a deceptive manner; (c) generate content sexualising or depicting minors; (d) infringe intellectual property, trademark, or privacy rights of others; (e) produce disinformation intended to deceive voters, investors or consumers; or (f) bypass our safety filters or rate limits. Violations may result in immediate account termination and, where required, reporting to law enforcement.

6. Your Content & Warranties

You retain ownership of all content you upload (inputs) and of the AI-generated outputs you create. By uploading content you warrant that you have the necessary rights and consents — including from any identifiable persons — to use it with the service. You grant us a limited licence to process, store and display your content solely to operate the service. We do not use your uploads to train our models without your explicit consent and we do not use your outputs for marketing without permission.

7. AI-Generated Content Disclosure

All outputs produced by Migla are artificially generated or manipulated. In line with Article 50 of Regulation (EU) 2024/1689 (the EU AI Act) you acknowledge that outputs are synthetic content and agree to disclose that fact when sharing them publicly, particularly in contexts where viewers could reasonably believe the content is authentic.

8. Credits, Payments & No Refunds

Certain features require credits purchased through our payment processor, Stripe. Credits are a prepayment for immediately accessible digital content. Once credits have been delivered to your account, all sales are final and non-refundable except where required by mandatory Latvian or EU law. You acknowledge and expressly request that we begin providing the digital content immediately upon purchase. Pursuant to Article 16(m) of Directive 2011/83/EU on consumer rights, and the corresponding provisions of the Latvian Consumer Rights Protection Law, you waive your 14-day right of withdrawal as soon as performance has begun, which happens the moment credits are added to your balance. We reserve the right to change pricing and credit allocations with notice; continued use after changes constitutes acceptance.

9. Content Reports & Notice-and-Action

In accordance with the EU Digital Services Act (Regulation 2022/2065) we operate a notice-and-action mechanism. Any person who believes content on Migla is illegal — including copyright or trademark infringement, non-consensual intimate imagery, impersonation, or privacy violations — may file a report via migla.io/report or by emailing support@migla.io. Reports are reviewed without undue delay and we take action consistent with our legal obligations and these Terms.

10. Internal Complaint-Handling & Appeals

Pursuant to Article 20 of the Digital Services Act, if we remove content, restrict its visibility, suspend or terminate your account, or refuse a generation request, you have the right to appeal the decision free of charge. You may lodge an appeal within six months of the decision by emailing support@migla.io with the subject line "DSA appeal" and including the affected content, account identifier, and the reasons why you believe the decision was wrong. Appeals are reviewed by a human — not solely by automated means — and we aim to respond within 14 days. If you disagree with our final decision, you are free to bring the dispute before a certified out-of-court dispute settlement body under Article 21 DSA, before Patērētāju tiesību aizsardzības centrs (PTAC), or before the courts of Riga, Latvia.

11. Deepfakes & AI Act Article 50(4) Disclosure

Migla can generate synthetic images and video that depict human likenesses. Under Article 50(4) of Regulation (EU) 2024/1689 (the EU AI Act), any person who deploys an AI system that generates or manipulates image, audio or video content constituting a deepfake must disclose that the content has been artificially generated or manipulated. You are the deployer for the outputs you create on Migla. By using the service, you undertake to (a) clearly label any output that could reasonably be taken for a real person as AI-generated or manipulated when you share, publish, distribute or otherwise make it available, (b) not remove or obscure any provenance metadata we embed in outputs, and (c) not use the service to create deepfakes of identifiable real persons without their documented, informed consent. These obligations apply in addition to the Acceptable Use section above and any stricter national law in your country of residence.

12. Intellectual Property

The platform, including its source code, original content, features, design and branding, is owned by SIA "MIGLAI" and protected by international copyright, trademark and other intellectual property laws. Nothing in these Terms grants you a licence to use the Migla name, logo or trademarks without prior written consent.

13. Limitation of Liability

To the maximum extent permitted by law, SIA "MIGLAI" and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use the service, including loss of profits, data or goodwill, even if advised of the possibility of such damages. Our total aggregate liability arising out of or in connection with the service shall not exceed the amount you have paid us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Latvian or EU law, including liability for gross negligence, intentional harm, or consumer statutory rights.

14. Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the service will immediately cease. All provisions which by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Riga, Latvia. EU consumers retain the protection of mandatory provisions of the law of their country of residence and may also bring disputes before the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to Terms

We may modify these Terms at any time. For material changes we will provide at least 30 days notice via email or in-app notification before they take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the latest revision.
